Terms of Service for Vibe-Check (Freelance Collective)
1. Introduction Welcome to Vibe-Check, a collective of freelance software specialists offering services in debugging, troubleshooting, code review, and deployment assistance. By engaging with any of us, you agree to these Terms of Service ("ToS"). Please review them carefully before we begin working together. Though we operate under the shared name "Vibe-Check," we are independent professionals collaborating on a flexible basis rather than a registered company. 2. Services Offered As freelancers, we each bring individual expertise to the following areas: Debugging and Troubleshooting – Identifying and resolving issues in your code. Code Review – Offering suggestions to improve the quality and maintainability of your code. Deployment Assistance – Helping you deploy your software to live or production environments. We collaborate remotely via email, virtual calls, and screen-sharing tools. Technologies and programming languages supported are determined individually per project.
3. Eligibility and Engagement Anyone is welcome to request our assistance. There's no need to register an account. To work with us, you'll need to share basic contact information and relevant portions of your code or project. All information is handled in compliance with the General Data Protection Regulation (GDPR) and other applicable privacy laws.
4. Payment Terms There is no charge until we agree on a service scope. After an initial conversation, one of us will provide a custom offer tailored to your needs. Payments: One-time payment due upon acceptance of the offer. Methods Accepted: PayPal, Venmo, and various cryptocurrencies. Refunds: Due to the digital and customized nature of our work, no refunds can be issued once service is delivered. Taxes are handled in accordance with each freelancer’s country of residence (primarily Germany), and international clients are responsible for complying with their own tax obligations.
5. Limitations of Liability We act as advisors and implementers based on the information you provide. As such, we can’t be held liable for any damages or negative outcomes related to your software. We also reserve the right to refuse services that involve illegal activity, malicious code, or infringement of others’ rights.
6. Intellectual Property You remain the sole owner of your code and intellectual property. We do not claim any rights over your work and will never use, reproduce, or share your code beyond the scope of our direct engagement—unless you give explicit permission.
7. Data Privacy We may collect the following data when working with you: Contact Details (e.g., your name and email address) Code or technical information relevant to the task Payment details, solely for billing purposes By engaging our services, you consent to the storage and use of this data per our Privacy Policy. We handle all personal and project data in line with GDPR.
8. Warranties and Disclaimers We strive to offer helpful, skilled services, but we can't guarantee specific outcomes or error-free results. All work is provided "as-is", and by using our services, you waive the right to hold us liable for any technical or business impact resulting from our contributions.
9. Support and Maintenance Once the agreed-upon service is delivered and your issue is addressed, our involvement ends unless otherwise agreed in writing. Ongoing support or future updates are not included unless specifically arranged.
10. Governing Law and Dispute Resolution These Terms are governed by the laws of Germany, where most of our freelancers are based. Any disputes related to these Terms or our services will be handled under German jurisdiction, regardless of where you're located.
11. Updates to These Terms We may update these Terms of Service as needed. Any changes take effect once posted on our website. You're encouraged to review the Terms periodically. Continued use of our services implies acceptance of any updates.
12. Termination Our work is structured as one-time or short-term engagements. Once the service is complete, the engagement concludes naturally. There is no ongoing contract to terminate unless otherwise specified.
13. Miscellaneous Force Majeure: We're not responsible for delays or failures due to events beyond our control (e.g., internet outages, illness, emergencies). Severability: If any part of this ToS is deemed unenforceable, the remaining parts remain valid. Entire Agreement: These Terms represent the full agreement between you and the individual freelancers working under the Vibe-Check name.
